But when you are a drug addled lunatic – a man who gets his kicks off of the sexual blackmail of little girls – you do something that is the complete opposite.

For those of you new to BV Files, here is a guide to help you understand the players, who we don’t like, and why:
- ViaView, Inc. is a company incorporated in Delaware that is owned by seven guys involved in the construction industry in Las Vegas, Nevada.
- Cheaterville.com is a revenge porn site that is run by ViaView. On Cheaterville people can post intimate photos and personal details about their ex-. If you find yourself posted on Cheaterville, you will be forced to pay them $199 (or more!) if you want to ransom back your photos and get the post removed.
- Bullyville.com is a hate speech / bullying website that is run by ViaView. While on the surface the website looks innocently enough, if you just barely scratch the surface by looking in its Articles section you will find some of the most vile and ugly hate speech one could ever imagine.
- James Alex McGibney. He is born in Oct. 31, 1973, from the town of Monroe, NY, who lives in San Jose, CA, and is married to Christina Orduna McGibney (born in June 12, 1981 in the SF-Bay area), with whom he has three small boys with. He is a liar, a thief, and a criminal – seriously. He has falsely claimed to having an Executive Education from Harvard Business School. He does have a FAKE college degree from Chadwick University, a well known diploma mill since shut down by the Govt., and has filed for Ch. 7 bankruptcy at least twice in recent years.
The owners of ViaView consist of the following individuals:
- Dave Suder – West Coast President/CEO of KHS&S Contracting, who is also on the Board of Regents for Servite Catholic High School in Anaheim, CA. His son David Stone Suder is currently on trial in Orange County, CA for multiple counts of child rape involving VERY YOUNG CHILDREN!
- Mark Caspers – owner of Las Vegas based Caspers Construction Company, LLC.
- Michael T. Carr – a man who calls himself “The Profit Prophet” (bet he didn’t see this coming?) and who is currently in hiding from his wife’s divorce lawyer.
- Wayne P. (Pat) Hibbs – President/CEO of Caspers Construction Company, LLC.
- Nikolas (Nick) Mamula – owner of a Las Vegas pre-fabricated stone products & tile company called T. Nicholas Co.
- Scott Corey Ryan – a lawyer licensed to practice law in Arizona, Illinois, and Nevada who is employed by Caspers Construction Company, LLC.
- James McGibney – serial resume fraudster & deadbeat with TWO Chapter 7 bankruptcies under his belt.
Q: What is an LOLsuit and why do you constantly refer to them here?
A: An LOLsuit is a portmanteau from taking “LOL” (Laugh Out Loud) and combining it with “lawsuit.” Thus, an LOLsuit is a joke lawsuit, or a lawsuit that is a joke. Note that it is a very real lawsuit filed in a real court. But the premise behind the lawsuit, or the legal reasoning expressed therein, is a total joke (i.e. makes one LOL when reading it).
Q: Why do you call McGibney Jimmy the Piss Boy or other derivations of that moniker?

Fun Fact: That Al-Jazeera article on McGibney was David Kushner’s first, last, and only article he ever wrote for them. According to statements from McGibney’s attorney, Jay Leiderman, in the federal court LOLsuit, McGibney was under the impression that he was going to be featured in Rolling Stone magazine (dumb ass). Since the October 2014 Al-Jazeera article, Kushner has written no less than SEVEN other articles that have appeared in Rolling Stone magazine – none of which ever had anything to do with James McGibney (who we don’t like).

Since today (November 11th) is Veteran’s Day in America, we would like to honor James McGibney as a former member of the U.S. Marine Corps. McGibney has repeatedly claimed under oath in various courtrooms that he is a cyber-security expert who was specifically trained by the Marines to hunt down anonymous internet users and to figure out what IP address goes to which person and where they are physically at.
Seriously – he claims he can do all of that shit – and leap tall buildings in a single bound – all without any kind of police powers or warrants.

For those of you at home keeping score, for case H042910 (the disqualification of the judge), Retzlaff’s original and reply briefs have been accepted and filed. No opposition was accepted (we wonder why that was). As of 12 pm PT on November 10 the court has listed the case as “fully briefed” which means the case is sitting on the desks of each of the justices of the court of appeals.

In checking the Court’s website just now, absolutely nothing has changed.

Now keep in mind that NO OPPOSITION was accepted by the court! Leiderman attempted to file two separate items – both of which were struck from the record by the court because McGibney did not have enough money to pay the court filing fees.
We here at the BV Files do not normally like to make predictions as to how court cases are going to come out. But in this case, it seems clear what the outcome will be since there is no opposition to Retzlaff’s requests to having the trial judge removed or the WordPress subpoena blocked. By failing to oppose, McGibney is, under the law, consenting and agreeing to the facts in the petitions.
FUN FACT: Thomas Retzlaff is not just the hero that we want. He is the hero that we need – 100% VERIFIED. Both he and Houston attorney Jeffrey Dorrell have completely and utterly destroyed blackmail artist James McGibney and his ViaView revenge porn company. The fact that they have also destroyed Paul Gianni, Jay Leiderman, John Morgan, Evan Stone, Rob Holmes, and Philip Klein has just been icing on the cake.

We guess the reason why this was sent is because James (Jimmy the Piss Boy) McGibney has made false claims before about what kind of car his Number One Enemy drives, just like he made false claims about where he supposedly lived at. Even with the front license plate and the vehicle registration sticker redacted we suspect that ace detective Philip Klein will be able to figure out where in Texas this car is registered and will be able to track down our American Hero, right? Right?? Yeah, we didn’t think so, either.
So it seems that despite the best efforts of James McGibney (who we don’t like) – and the most able legal assistant possible from his attorney Evan Stone (whose real name is Evan Hugh Flournoy) – McGibney has a date with some good old fashioned Texas Justice in the form of a lynching in the courthouse square. Well, not exactly. We wish we could view the murder of James McGibney – we’d live stream it in a heartbeat, seriously. Unfortunately, we will just have to be satisfied with viewing the paperwork.
McGibney is facing court sanctions for violating the Texas Citizen’s Participation Act (Texas CPA), which is their version of the anti-SLAPP statute found in so many states. A strategic lawsuit against public participation (SLAPP) is a lawsuit that is intended to censor, intimidate, and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition. The typical SLAPP plaintiff does not normally expect to win the lawsuit. The plaintiff’s goals are accomplished if the defendant succumbs to fear, intimidation, mounting legal costs or simple exhaustion and abandons the criticism.
The aptly named #TeamPhelon (which consists of our American Heroes and Honorary Admins of the BV Files Dorrell, Retzlaff, Neal Rauhauser, and several others) are seeking over $1.3 million in mandatory sanctions and attorney’s fees against McGibney and ViaView, Inc. We emphasize the word “mandatory” because, when McGibney lost his appeal of this case, the Fort Worth Court of Appeals sent the case back to the trial court for the imposition of sanctions and the assessment of attorney’s fees against McGibney.
So when attorney Dorrell filed his motion for sanctions last week with the trial court, what did McGibney do?
How Dorrell responded to this ridiculously stupid bit of provocation is absolutely epic. CHECK IT OUT!
So how will all of this work out for McGibney? And will attorneys Evan Stone and Jay Leiderman be able to pull a rabbit out of a hat and save Team Bullyville?
